  1. Amendment
  2. Rider

Analysis

In Chinese contract law, an amendment is an agreement made after a contract to supplement its original terms, whereas a rider is a set of supplementary terms attached to the contract at its time of signing.  This concept is well-known to American law, and the two terms are widely used in contracts (see reference).

Correct use of this term in contracts is essential in order to be unambiguous about the currently applicable terms. See our {Article on the Chinese law concept for more details.

China English

Translation Equivalents

  1. Supplementary Agreement

Analysis

In China if you are a government translator, you are not permitted to translate to American English.  When doing translations, take care to delete statements such as “in China, this is known as a supplementary agreement,” in order to avoid creating the fiction that the population is familiar with these English expressions. The primary reason for the existing standardized translation is that Chinese uses different terms for amending contracts as compared with statutes, and China’s English standards committee required a strict 1-to-1 match between the terms.
