Analysis

Liability in Chinese law are monetary or performance obligations imposed on a person for violating their legal duties.  In English law, this is referred to as legal liability or liability for short. Use of this term in legal documents is essential in order to be unambiguous about the legal results that will occur for parties to a lease. See our article on the concept of legal liability in Chinese law for more details.

Consumer Disclosures

Translation Equivalents

  1. Legally Responsible
  2. Legally Liable

Analysis

In American consumer disclosures, it is customary in many cases to say that a person will be held “responsible” as opposed to having liability. This is done where there may be some doubt as to the consumer’s literacy, or where the word ‘liability’ may be too intimidating.  This approach to using colloquial expressions is typically used in non-binding texts that explain or make clear the meaning of a primary legal text to a consumer.  For example, a consumer lease may describe liability for rent, whereas an email from a landlord may threaten responsibility for failure to pay the rent.
